KEY QUALIFICATIONS

Combines his engineering qualifications and experience and backgrounds in finance, management and organisational structures with current experience in the optimisation and improvement of the provision of municipal services.   Has led the advisory team in a number of public/public and public/private partnership programmes in South Africa mainly involving the water and sanitation sector.   Recent experience includes direct involvement in the operation and future structuring of a number of water services authorities as well as working as an advisor within a municipality service delivery department.  Has also led diagnostic study teams who assessed the ability of various municipalities in respect of service delivery, financial soundness and the potential for local economic development.   

Registered as an engineer in South Africa, his background is municipal engineering gained from working in a new town and local authorities in the UK as well as with consultants in South Africa.  As an active member of Toastmasters International, he is a skilled presenter and facilitator and has over 20 years experience in top management positions where he was responsible for all aspects including finance, administration, legal, human resources and information technology.  Has completed the Advanced Executive Programme at the School of Business Leadership of the University of South Africa (UNISA) which covered such areas as strategic management, organisational behaviour, finance, etc.

eThekwini Metropolitan Municipality
Specialist on team (with 3P Consulting and Africon) appointed to undertake a Section 78 study into the optimum future arrangements for the asphalt production plant and asphalt paving operation of the municipality.   Although this is a non-core function the study revolved around any benefits that were accruing to the municipality from having this in-house operation.  May – Nov 2008

Local Municipality of Madibeng
Specialist
on team (3P Consulting) appointed by the municipality to complete the Section 78 study for the optimum structuring of the water and sanitation delivery process.   Provided specific input on the technical, institutional and financial arrangements.   As an extension of this study undertook a feasibility study as to the appointment of a local mine to operate as a supplier of potable water using its mine de-watering as the resource.   June 2007 – December 2008

Review of Section 78 Process for Ugu District Municipality

appointed by the Municipal Infrastructure Investment Unit to undertake a review of the process and reporting of the consultants group advising Ugu District Municipality in respect of their studies on alternative service delivery options for the provision of water and sanitation services – undertaken to comply with the Municipal Systems Act.   Also provided guidance as to future direction on the investigations.   July 2004

Nelspruit Water Services Concession for Mbombela Local Municipality

• advising on improved systems for contract monitoring in respect of the water and sanitation concession contract including the development of a monitoring manual, changed methods of reporting to Council and more detailed job descriptions and systems;
• undertaking the five-year review of the performance of this public/private partnership water and sanitation concession contract.   Areas covered include the review of actual achievements against target, analyses of the impact of changed conditions, assessment of the impact of the loss of DWAF subsidies, an assessment of the impact of the introduction of free basic water and analysis of the expenditure and revenue model to assess proposals for tariff increases;
• providing input to the Supplementary Agreement with specific reference to Key Performance Indicators for measuring the performance of the concessionaire.

Private Research into the Financial and Capacity Factors in South Africa’s Municipalities which Influence their Capacity to Undertake Service Delivery
Undertook this research work as a personal project to better understand the various factors which impact on the capacity and ability of all 284 municipalities to achieve their service delivery responsibilities.   Determined over 90 municipalities which are going to require considerable support in the medium term if they are going to achieve their objectives.   Project culminated in the presentation of a paper “The Forgotten Municipalities” to the national conference of the Institution of Municipal Engineers.   The paper received the award for the best paper by a non-member of the Institution.   January – October 2004

Diagnostic Study of the Imbabazane Local Municipality, KwaZulu Natal, for the Municipal Infrastructure Investment Unit
Specialist undertaking a broad based study of the ability of the municipality to perform its responsibilities in terms of the Constitution and allocated powers and functions.   For this municipality the main focus was the financial structure of the municipality, human resources, potential and concepts for local economic development, the provision of services and potential income generation.    September 2003 to January 2004

Study of Future Options for the Delivery of Water Services for Maluti a Phofung Municipality, Free State
Specialist
, appointed in association with the legal consultants, Ashira Consultants, to undertake the above study, in accordance with the requirements of section 78 of the Municipal Systems Act.   The purpose of the study is to assist the municipality to make a considered decision of how to best provide water services after the two existing public/public management contracts come to an end in June 2004.   The process involves considering an internal mechanism initially and then, after a decision by Council, to consider the various options of external mechanisms.   This project is being used as a pilot study to test the application and inter-dependence of the various aspects of legislation which impact on this type of process.   Funded by the MIIU.    July 2003 to June 2004.

Service Delivery Agreement between Emfuleni Municipality and a Municipal Entity Water Services Provider

providing input into the finalisation of this Service Delivery Agreement.  The specialist advice involved assisting the legal consultants to the Council (Ashira Consulting) in the finalisation of the legal agreement document and the compilation of the annexure of key performance indicators.

Upgrade of Water Supply Services for Mabeskraal Pilot Project in Moses Kotane Municipality, for Magalies Water Board
Specialist Advisor providing input into institutional systems, municipal policies, tariff setting and cost recovery systems for this pilot project to establish a realistic and sustainable water service in this town of 20,000 population.   Appointed consultant is BKS.

Da Gama Process Treatment Plant, Eastern Cape
Specialist Advisor in respect of the structuring of the procurement process and contract documentation for the establishing of a 10 year contract for the construction, finance and operation of an industrial waste water treatment plant to provide treated and semi-treated water back into the plant for re-use.   Appointed consultant is BKS.   Jan 2003 – Mar 2004

Diagnostic Study of the Bushbuckridge Local Municipality, Limpopo Province, for the Municipal Infrastructure Investment Unit
Specialist undertaking a broad based study of the financial and organisational structure of the municipality based on the allocated powers and responsibilities.   Focus areas included the balancing of the budget as well as service delivery in respect of roads and stormwater maintenance, solid waste management, public safety and traffic services, community services and municipal planning.

Capacity Building Workshop on Public-Private Partnerships for the Urban Environment in the SADC Region, DBSA / UNDP, South Africa

at this workshop organised by the DBSA on behalf of the UNDP. Workshop was focussed on creating capacity to initiate and manage bankable projects, encouraging local authorities throughout SADC to consider PPP options for projects and to impart practical skills and experience from existing work.

Rural Towns Water Supply and Sanitation Study, Ministry of Water, Lands and Environment, Uganda
Specialist
responsible for the Tariff aspects for a study involving strategic planning, feasibility studies and the preparation of detailed designs and tender documents for the improvement of water and sanitation services in seven medium sized towns.   The challenge in respect of the tariff aspects was to achieve a balance between achieving cost recovery and a sustainable self financing service while still ensuring that the poor were able to access basic levels of services in respect of personal needs and family hygiene.   Appointed consultant was BKS Group and Kagga & Partners Ltd.   Project funding from the African Development Bank.   June 2002 – November 2004

Advice to Moses Kotane Municipality in Respect of Water and Sanitation Service Delivery
Specialist, advising Moses Kotane Local Municipality on their responsibilities and powers in respect of the provision of water and sanitation services.   October 2001 – January 2002.

Feasibility Study on Service Delivery Options for Water and Sanitation Service Provision for uMhlathuze Local Municipality
Study Leader
of a multi-disciplinary team to undertake an investigation of possible delivery options for this new municipality which combines Richards Bay and Empangeni as well as the surrounding peri-urban and rural areas.   The area represents a mix of water users from major industrial to isolated rural.   The study was structured to identify, in terms of the processes set out in the Municipal Systems Act, whether the municipality has the necessary capacity to undertake the service provision through its own internal structures or whether there would be any benefit in looking at a partnership approach.   Funded by the MIIU.
October 2001 – June 2002.

Diagnostic Studies into Service Delivery Restructuring for District Municipalities and Aspirant Metropolitan Councils, Municipal Infrastructure Investment Unit
Team Leader of a small team of specialists who undertook high level studies into the financial and service delivery capacity of district municipalities and aspirant metros.   The studies were focussed at identifying possible restructuring methods or ways to improve the delivery of services which are the responsibility of these municipalities in terms of the Municipal Structures Act (as amended).   The specially selected team used its knowledge and experience gained in similar projects throughout South Africa to suggest ways in which the municipality can better meet the responsibilities which have been allocated to it.  Studies included Nelson Mandela Metro (based in Port Elizabeth), Mangaung (based in Bloemfontein), Ugu (based in Port Shepstone) and uMsunduzi (based in Pietermaritzburg).  August 2001 – January 2002.

Formalisation of Water and Sanitation Services Delivery Arrangements for Maluti a Phofung Local Municipality, Free State
Study Leader
to initially determine the current status of the arrangements between the Department of Water Affairs and Forestry, a water board which is currently providing the water and sanitation service and the newly constituted local municipality.   The purpose of the study was to give guidance to the various parties on the options to formalise the arrangements and to identify a way forward for the future.   This then led to the preparation and negotiation of a contract whereby the water board will act as the service provider on behalf of the municipality.  Funded by MIIU.   March to December 2001.

Contract Monitor providing on-going support and advice to ensure that the terms of this public/public contract are complied with by the parties and to monitor and report on the extent that the contract is achieving the objectives.   April 2001 – June 2005

Development of Model Contracts for the Department of Water Affairs and Forestry
Appointed to develop three draft model contracts:
• Bulk supply agreement between DWAF and a water services institution
• Transfer of assets agreement from DWAF to a water services authority
• Agreement where DWAF acts as water services provider on behalf of a water services authority.

Feasibility Study on Service Delivery Options for Water and Sanitation Service Provision for Ehlanzeni District Council (formerly Lowveld Escarpment)
Study Leader
of a multi-disciplinary team to undertake an investigation of possible municipal service delivery options for one of the local council areas forming this district council.   January 2001 – June 2002

Retail Water Distribution Project for Bushbuckridge
Core Team Member working for Chemonics International and ValuAdd on a four year technical assistance programme, funded by USAID, which has the overall objective of building capacity within the Water Services Authority.   The service is currently provided by the national Department of Water Affairs and Forestry who have recently established a Water Board who will be responsible for the bulk supply to the area.   The recently created local authority for the area, which is also the Water Services Authority, has no history of providing water services and will have to develop this capacity through transfer of staff and resources from the national department as well as developing its own capacity.  The programme provided assistance to empower them to be able to accept the responsibility of the provision of an adequate and sustainable retail water service to this mainly rural area in the Limpopo Province.  

Responsible for providing detailed specialist inputs in respect of:
• Appropriate policy and regulatory arrangements
• The creation, format and responsibilities of the Water Services Provider Partnership
• Capacity building within the municipality
• The process of transfer of assets from DWAF
• Procurement of appropriate staff and their training/developmental needs
• Operations and maintenance
• Cost recovery and financial sustainability aspects
 October 2000 – March 2005.

Management Contract between the Harrismith Local Authority and Rand Water Board
Lead Consultant
to Harrismith Transitional Local Council in the Free State advising them on the finalisation of a three year interim management contract for the provision of water and sanitation services with Rand Water, a public water board.   Responsible for the final negotiations on the contract and for structuring a balanced contract between the two parties.   The contract is supported by a business plan which defines the interventions that are required of the water board.   This project has particular importance as it has been identified as a prime example of a public/public (as opposed to a public/private) partnership.   Funded by MIIU.    June 2000 – October 2000

Study into Water & Sanitation Delivery Options for the City of Umtata
Study Leader
of a multi disciplinary team investigating possible options for private sector participation in the improved delivery of water and sanitation services for a population of some 340 000.   Study will investigate the technical, financial, legal, socio-economic and human resource implications leading to recommendations to the City officials and councillors in respect of the optimum structure for future service delivery.   Funded by MIIU.

 Impact of Privatisation on the Poor, Development Bank of Southern Africa
Contributor to a report which looked at a selection of projects to identify how private sector participation in municipal service delivery has contributed to the alleviation of poverty and which discussed methods whereby such contributions can be maximised.  November 1999.

 Investigation into Water & Sanitation Delivery Options, Kwa-Dukuza TLC

to the investigation team in respect of public and private sector participation options in optimising the service delivery process.   Includes assessing the current condition of the service and developing recommendations on the relative benefits of different options.   Funded by MIIU.   August 1999 – date.

Development of Model Private Sector Contracts, Dept of Water Affairs & Forestry
Technical Advisor
for the drawing up of model contracts as required by the regulations that relate to the Water Services Act (Act 108 of 1997).   Model contracts covered bulk water supply, management, concession and NGO/CBO outsourcing.  Also advising the Department on the drafting of the regulations which clarify certain aspects of the Act.  March 1999 – September 1999

Private Sector Outsourcing for Sanitation Services, Margate TLC
Project Leader for an evaluation of the possible benefits to be obtained through private sector involvement in the provision of sanitation services to this coastal resort area.   Followed up with being appointed to implement the recommended management contract including the management of the selection process and the development of the necessary contract documentation.    Funded by MIIU.

 Consult Consortium (Pty) Ltd, Mpumalanga
Specialist
work in developing systems for the implementation of cost recovery systems, the creation of appropriate legal and institutional environments, the optimisation of operations and maintenance expenditure and the establishment of a commercial basis for the provision of sustainable water and sanitation services in the province of Mpumalanga. Consult Consortium was responsible to the Department of Water Affairs and Forestry for the implementation of a build, operate, train and transfer (BoTT) project.

Investigation into Private Sector Participation Options for the Hydraulic Branch of  Port Elizabeth Municipality
Project Leader
for an initial study to identify various options for private sector participation for the water supply and sanitation services for the City.  Led a team of financial, social and technical experts who undertook the investigation and who made recommendations to the Council as to the options to be considered further.   Funded by MIIU.   May 1998 - October 1998.

Restructuring of Water, Waste and Sewage Services, Greater Pretoria Metropolitan Council, South Africa
Project Leader
for an investigation into methods of improving the efficiency of the water supply, solid waste disposal and sanitation services of the Metropolitan Council with possible extension to include the related functions of the next level local councils. Investigation included consideration of the benefits, or otherwise, of placing such services into specially established, non profit making, companies and the likely managerial, legal and financial structure of such companies.     October 1997 - June 1998.

Concession for Water and Sanitation Services, Nelspruit, South Africa
Technical Advisor
as member of team evaluating bids for a 30 year concession for water and sanitation services for Nelspruit Transitional Local Council to serve a population of 300,000.  Was responsible for the assessment of the capabilities of the bidders as well as the analysis of the performance standards, capital investment programmes, operations and maintenance proposals and the tariff structure.
Team Leader of the advisory group negotiating the contract with the preferred bidder and assisting Council members and officials to conclude the terms of the contract. Provided major inputs into the development of the detailed concession agreement including aspects such as technical standards, tariff structuring, contract monitoring, hand over procedures, transfer of personnel, performance standards, etc.   This was the first such concession of its type in South Africa.      May 1997 – April 1999.

Strategic Planning for Directorate of Department of Water Affairs, South Africa
Facilitator
for various meetings and solution seeking exercises.  Assisted Directorate: Project Planning of the Department of Water Affairs and Forestry to develop their strategic plan within the changing institutional framework of the Department and the changed approach to water provision in South Africa.  Services included facilitating an all day workshop with the senior staff of the Directorate.  1997 and 2001.
